These Terms and Conditions govern your use of the services provided by CMS Lab Co Ltd, including but not limited to Software-as-a-Service (SaaS), Platform-as-a-Service (PaaS), and Infrastructure-as-a-Service (IaaS).

By accessing or using any part of our services, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree to all the terms, you may not access or use our services.

1. Definitions

  • “Company” refers to CMS Lab Co Ltd.
  • “User”, “You” refers to the person or entity using the services.
  • “Services” means all products, platforms, systems, and related support provided by the Company.

2. Use of Services

  • You must be at least 18 years of age or have legal capacity under Thai law.
  • You agree to use our services only for lawful purposes and in accordance with these Terms.

4. Payments and Billing

  • All fees are stated in THB or USD unless otherwise agreed.
  • Payments are typically charged at the time of checkout. Custom billing cycles may apply based on service agreements.
  • Failure to pay may result in service suspension or termination.
  • Prices are subject to change with reasonable notice.

5. Service Availability

  • We strive for 99.9% uptime and high performance. However, we do not guarantee uninterrupted access.
  • Maintenance, updates, and external factors may occasionally affect availability.

6. Intellectual Property

  • All content, software, and designs provided by the Company remain the property of CMS Lab Co Ltd or its licensors.
  • You are not permitted to copy, reproduce, distribute, or reverse-engineer any part of the service without prior written permission.

7. Data Protection and Privacy

  • We collect and process personal data in accordance with the Personal Data Protection Act B.E. 2562 (PDPA) of Thailand.

8. Limitation of Liability

  • CMS Lab Co Ltd shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use our services.
  • Our total liability for any claim shall not exceed the amount paid by you for the specific service in the 30 days preceding the claim.

9. Termination

  • You may terminate services at any time by written notice or using your dashboard (if available).
  • We may suspend or terminate access for breach of these Terms or unlawful activity.

10. Governing Law and Jurisdiction

  • These Terms shall be governed by the laws of the Kingdom of Thailand.
  • Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

11. Modifications

  • CMS Lab Co Ltd reserves the right to modify these Terms at any time. Updated versions will be published on our website.
  • Continued use of the services after changes indicates your acceptance of the new terms.
